Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Touchline platform operated by Touchline ("we", "us", "our"). By accessing or using our platform at touchlineapp.uk, you agree to be bound by these Terms.

1. Definitions

• "Platform" means the Touchline web application, API, and related services
• "Club" means a sports club organisation that registers for an account
• "User" means any individual who accesses the platform on behalf of a Club
• "Content" means any data, text, images, or materials uploaded to or generated through the platform
• "Subscriber" means a Club with an active paid subscription

2. Account Registration

To use the platform, you must:

• Register an account with accurate and complete information
• Be at least 16 years of age
• Be authorised to act on behalf of the Club you are registering
• Keep your login credentials secure and confidential

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

3. Use of the Platform

You may use the platform to:

• Manage your club's commercial and sponsorship operations
• Create and send proposals, invoices, and agreements to sponsors
• Track deals, contacts, and company relationships
• Manage fixtures, assets, and match day operations
• Connect social media accounts and view analytics
• Accept payments through integrated payment providers

Prohibited Uses

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the platform
• Interfere with or disrupt the platform or its infrastructure
• Upload malicious code, viruses, or harmful content
• Resell, sublicense, or redistribute access to the platform
• Scrape, crawl, or extract data from the platform by automated means
• Impersonate another person or organisation

4. Subscriptions and Payment

Access to the platform is provided on a subscription basis. Subscription plans, pricing, and features are described on our Pricing page.

• Subscriptions are billed monthly or annually as selected at the time of purchase
• All fees are quoted in GBP and are exclusive of VAT unless stated otherwise
• Payments are processed securely via Stripe. We do not store your payment card details
• Subscriptions renew automatically unless cancelled before the renewal date
• We reserve the right to change pricing with 30 days' notice

5. Payment Processing for Clubs

Clubs may use the platform to accept payments from sponsors and customers via Stripe Connect. By enabling this feature:

• You agree to Stripe's Connected Account Agreement
• A platform fee is deducted from each transaction as described in your subscription terms
• We are not responsible for disputes between you and your customers or sponsors
• Refunds and chargebacks are your responsibility as the merchant of record

6. Third-Party Integrations

The platform allows you to connect third-party services including social media platforms (Meta, Twitter/X, TikTok, YouTube), email providers (Gmail, Outlook), and payment processors (Stripe). When you connect these services:

• You authorise us to access data from those services as described in our Privacy Policy
• You are responsible for complying with the terms of each third-party service
• We are not liable for any changes, outages, or limitations imposed by third-party providers
• You can disconnect any third-party service at any time from your Settings

7. Your Content

You retain ownership of all Content you upload to the platform. By uploading Content, you grant us a limited licence to store, process, and display it as necessary to provide our services.

• You are responsible for ensuring you have the right to upload and share your Content
• We will not use your Content for marketing or other purposes without your consent
• Upon account termination, your Content will be deleted in accordance with our Privacy Policy

8. Intellectual Property

The Touchline platform, including its design, code, branding, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our prior written consent.

9. Availability and Support

• We aim to maintain platform availability but do not guarantee uninterrupted access
• We may perform scheduled maintenance with reasonable advance notice
• Support is provided via email and our contact form during business hours
• We reserve the right to modify, suspend, or discontinue features with reasonable notice

10. Limitation of Liability

To the maximum extent permitted by law:

• The platform is provided "as is" without warranties of any kind, express or implied
• We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform
• Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss of revenue, data, or business opportunities

11. Termination

Either party may terminate the agreement at any time:

• By you: Cancel your subscription at any time. You will retain access until the end of the current billing period
• By us: We may suspend or terminate your account for breach of these Terms, with notice where practicable
• Upon termination, your right to access the platform ceases immediately
• We will delete your data within 90 days of account closure, except where retention is required by law

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
